FMCSA (Federal Motor Carrier Safety Administration) requires the driver of a commercial motor vehicle involved in an accident on a public roadway in commerce to undergo post-accident DOT drug and alcohol testing when a human fatality occurs, regardless of fault. In non-fatal accidents, the CMV driver is required to undergo post-accident DOT drug and alcohol testing if 1) the CMV driver receives a citation for a moving violation and one or more vehicles involved in the accident is disabled, requiring the vehicle(s) to be removed from the scene by tow truck or other vehicle or 2) the CMV driver receives a citation and treatment away from the scene is required for anyone involved in the accident.

FTA (Federal Transit Administration) requires personnel involved in operation of a mass transit vehicle to undergo post-accident DOT and alcohol testing when a human fatality occurs, regardless of fault. In non-fatal accidents, operating personnel must undergo DOT post-accident drug and alcohol testing if 1) a vehicle involved in the accident must be removed from the scene because of disabling damage and the operators cannot be completely removed from responsibility for the accident or 2) someone involved in the accident receives immediate treatment away from the scene and the operators cannot be completely removed from responsibility for the accident.
